From Genocide to Unlawful Occupation: Key Developments in International Law Respecting the Israel/Palestine Conflict

Abstract: The past year has seen incredibly important developments in international law as it relates to the Israel/Palestine conflict. A series of landmark cases and questions have been brought to both the International Court of Justice (ICJ) and the International Criminal Court (ICC). This talk will review key moments and findings in South Africa’s genocide case against Israel; the ICJ’s advisory opinion on the legality of Israel’s occupation of Palestinian territory; Nicaragua’s complicity case against Germany; and the Prosecutor’s application for arrest warrants against Israeli and Hamas leaders at the ICC. It will reflect on the role of international law in resolving political conflict and advancing Palestinian freedom, highlight challenges facing each of these cases as they proceed, and examine Canada’s compliance with its international legal obligations in this context.

 

Bio: Dr. Heidi Matthews is an assistant professor of law at Osgoode Hall Law School at York University. She researches and teaches in the areas of international criminal law, the law of war, international legal history, and political theory. Her work theorizes contemporary shifts in the practice and discourse of the global legal regulation of political violence, with particular attention to history and gender, as well as political, critical, and aesthetic theory. She is currently a visiting professor at Memorial University’s political science department.
